SEVERINO and SIMON cases (USA). Briefly:

SEVERINO was driving drunk. THIS TIME, a cop made
a mistake, he MIRANDIZED Severino; who was not
too drunk to 'lawyer up'. They convicted him anyway.

The attorney general then had to explain why traffic

and his pathetic 20 plus year history of detax failure reminds me of
"Danger Barch" the film's Forest Gump-like character who hangs around
the gym and despite having zero fighting skills is tolerated by Frankie
Dunn (Clint Eastwood), only to be harassed by the less forgiving
fighters training there.

Early in the film the stick like Danger Barch (mimicking the delusional

handled a loaded 22 calibre rifle and it accidently fired a round
through his chest just above one of his lungs. Not realizing he had
shot himself, he climbs in a car his buddy, who was also drunk, was
driving. A few miles down the road he feels the warmth of his own blood
against his chest and just about freaks out. They realize they need to
get to a hospital but the buddy says he not driving there drunk. So the
shot boy takes the wheel and drives 30 miles to the nearest hospital
where the incident is reported to the RCMP. Upon learning the shot
drunk drove himself to the hospital, they promptly procede to charge
him several driving and firearms offences. However, a previous time
when he was sober, he had signed his driver's license using the
"without prejudice" above his signature. When asked for his driver's
license by the RCMP, he made it a point to inform them of that little
phrase. At the time the RCMP didn't pay much attention to the "without
prejudice" on the license. But sometime the following day, the same
officers appeared at his home and asked for the documents back that
they had served on him the previous evening. All charges were
voluntarily withdrawn by the RCMP in this case.

Maybe, just maybe there is something to "without prejudice" when used
in conjunction with your signature.

Hey children, a drunken local 50 year old boy stupidly and carelessly
handled a loaded 22 calibre rifle and it accidently fired a round

Hey children, a drunken local 50 year old boy stupidly and carelessly

SEVERINO and SIMON cases (USA). Briefly:

SEVERINO was driving drunk. THIS TIME, a cop made
a mistake, he MIRANDIZED Severino; who was not
too drunk to 'lawyer up'. They convicted him anyway.

The attorney general then had to explain why traffic
offenders are neither Mirandized nor Indicted.

a civil (breach of fictitious contract) matter."

Also, Simon tried to raise the ALL CAPS defense.

demanding to be informed of how the State acquired

Abbot) Eldon, the citation for the case is State v. Severino (Haw.
1975), 537 P.2d 1187). I figured you were too impaired and dishonest
to come up with it yourself, so I did the scholarship you should have,
had you been sane and honest.

Looking up the case it seems the points of law in play were 1) Whether
Severino's refusal to take the breathalyzer test until an attorney
was consulted constituted a refusal to submit to the test and; 2)
Whether the question is asked pursuant to Severnio's DUI violation a,
criminal offense, or with regard to an implied consent violation
(refusing to take the test), which is civil in nature.

Nowhere in this 31-year-old case do I see record of the all caps theory
or the Fugitive Slave Act being addressed, as you infer.
